• The Service provides security monitoring and helps protect the websites, systems, and digital environments of users

• Service availability may vary and may include interruptions, maintenance, or downtime

• Users must be at least 18 years old

• Account registration requires accurate and complete information

2. Limitation of Liability

To the maximum extent permitted by applicable law, Boteraser (and its owner Bojan Todorovski) shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses. Specifically, no responsibility is assumed for:

• System Failures: Data loss, business interruption, or system failures occurring while using the Service.

• Security Incidents: Any security incidents, successful attacks, or unauthorized access that may occur despite the use of the Service.

• Automated Detections: The Service uses automated algorithms that may occasionally incorrectly classify, flag, or restrict legitimate traffic (“false positives”). Boteraser is not liable for any resulting loss of traffic, revenue, or access.

• Operation: No warranty is provided that the Service will be uninterrupted, timely, secure, or error-free.

• Financial Limit: In any event, Boteraser’s total liability for any claims under these Terms shall be limited to the amount paid by the user for the Service during the twelve (12) months preceding the event giving rise to the liability.

• Refunds: Refund eligibility is strictly limited to prepaid subscription fees as defined in our Refund Policy.

You agree to indemnify, defend, and hold harmless Boteraser and its owner Bojan Todorovski from and against any claims, damages, losses, liabilities, costs, or expenses (including legal fees) arising out of:

• your use or misuse of the Service

• your violation of these Terms

• your violation of any law or third-party rights

• any content, systems, or infrastructure connected to your account

• Risk Management: Perform regular backups, system updates, and independent risk management practices. The Service is a security layer and does not relieve the user of their responsibility for overall system administration.

• Compliance: Comply with all applicable laws and regulations regarding data privacy and network monitoring.

• Monitoring: Regularly monitor their systems and report any suspected abuse or bypass attempts to Boteraser.

• Account Security: Maintain the confidentiality of account credentials and API keys.

• These Terms shall be governed by the laws of the Republic of Serbia

• Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts in Požarevac, Serbia.

• Users are responsible for ensuring their own legal compliance

• Compliance with applicable export control laws is required

• Users must comply with applicable privacy and data protection regulations

• Payments are processed through secure third-party payment providers
